5. User Content

You retain ownership of all data and content you upload to the Gray Ark platform, including assessment responses, documents, and reports. By using our services, you grant us a limited license to process and store your content solely for the purpose of providing the platform services.

6. Prohibited Uses

You agree not to use our services:

• In any way that violates applicable laws or regulations
• To transmit harmful or malicious code
• To impersonate or attempt to impersonate others
• To engage in any activity that interferes with or disrupts the services
• To collect or track personal information of others without authorisation

7. Early Access & Product Development

The Gray Ark platform is currently in active development and is offered on an early access basis. Certain features, capabilities, and integrations described on this website or discussed during demonstrations may be under development, in prototype stage, or planned for future release.

By participating in our early access programme, you acknowledge and agree that:

• The platform may not include all features described in marketing materials at the time of your engagement
• Features and functionality are subject to change, delay, or removal without prior notice
• Performance, uptime, and availability may not meet production-grade service levels during the early access period
• Pricing, terms, and feature scope for early access participants may differ from general availability terms
• Gray Ark makes no guarantee regarding the timeline for delivery of any specific feature or capability

Early access participants may be invited to provide feedback, participate in usability testing, or contribute to product direction. Any feedback, suggestions, or ideas you provide may be used by Gray Ark without obligation or compensation.

8. Disclaimer

Our services are provided "as is" and "as available" without any warranties, either express or implied. Gray Ark makes no warranty that the services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. This applies particularly during the early access period, during which the platform is under active development and may contain incomplete functionality.

9. Limitation of Liability

In no event shall Gray Ark, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Termination

We may terminate or suspend your account and bar access to our services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
